Terms governing use of Polk Mechanical’s public website

These Website Terms of Use (‘Terms’) govern your access to and use of www.polkmechanical.com and related public webpages operated by Polk Mechanical Company, LLC (‘Polk Mechanical,’ ‘we,’ ‘us,’ or ‘our’). By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.

2. Informational Purpose; No Contract

Website content is provided for general informational purposes. Nothing on the website constitutes a bid, proposal, construction contract, subcontract, purchase order, engineering opinion, professional design service, warranty, guarantee, employment contract, or other binding commitment unless expressly stated in a separate written agreement executed by an authorized Polk Mechanical representative.

3. Permitted Use

You may use the website for lawful personal, employment-seeking, or business informational purposes. You agree not to interfere with the website, attempt unauthorized access, introduce malicious code, circumvent security measures, impersonate another person, misuse forms, or use the website in violation of law.

4. Intellectual Property

The website and its content, including text, graphics, photographs, videos, designs, logos, trade names, trademarks, documents, and other materials, are owned by or licensed to Polk Mechanical and are protected by intellectual-property laws. 6. Recruiting and Employment

Job postings and recruiting content are informational and may be changed, withdrawn, or filled at any time. Submission of an application or resume does not guarantee an interview or employment and does not create an employment relationship or contract. Recruiting may be conducted through iCIMS and other authorized service providers. Applicant information is handled as described in our Privacy Policy and Applicant Privacy Notice.

7. SMS/Text Communications

If you opt in to receive text messages from Polk Mechanical, additional SMS/Text Messaging Terms apply. Consent to receive texts is not a condition of applying for employment. You may revoke consent as described in the SMS/Text Messaging Terms and applicable law.

8. Vendor, Supplier, and Subcontractor Submissions

Submitting qualifications, contact information, pricing, prequalification information, or other materials does not create an approved-vendor status, subcontract, purchase order, promise of work, or other contractual obligation. Only an authorized written agreement may bind Polk Mechanical.

9. User Submissions

If you submit non-confidential content through the website, you represent that you have the right to provide it and that it does not violate law or third-party rights. Do not submit trade secrets, confidential customer information, controlled information, or sensitive personal information through general website forms unless specifically requested through an approved secure channel.

10. Third-Party Services and Links

The website may link to or integrate third-party services. Those services are governed by their own terms and privacy practices. Polk Mechanical does not control and is not responsible for unaffiliated third-party websites or services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLK MECHANICAL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, BUSINESS OPPORTUNITY, OR GOODWILL, ARISING OUT OF OR RELATING TO USE OF OR INABILITY TO USE THE WEBSITE. 1. Scope and Introduction

Polk Mechanical Company, LLC (“Polk Mechanical,”
“we,” “us,” or “our”) respects privacy and is committed to handling personal information responsibly. This Privacy Policy
describes how we collect, use, disclose, retain, and protect personal information when you visit www.polkmechanical.com, interact with our online services, contact us, apply for employment, communicate with our recruiting team, or otherwise interact with us in a context covered by this Policy.

This Policy does not replace privacy notices that may apply
to employee benefit plans, protected health information, background checks, or other information governed by a more specific notice or law. Where a separate notice applies, that notice controls for the covered information.

Depending on your interaction with us, we may collect the

·    Internet, device, and network activity, such as
browser type, device characteristics, referring URL, pages viewed, timestamps,
interactions with site features, and cookie or similar technology identifiers.

·    Approximate location information inferred from

·    Communications, including emails, web-form
submissions, SMS/text messages, and other correspondence with us.

We do not intend to collect sensitive personal information
through ordinary public website pages unless it is reasonably necessary for a
disclosed purpose and permitted by law. Applicants should provide only
information requested through our recruiting process.

3. Sources of Personal Information

through cookies, pixels, tags, logs, and similar technologies.

·    From service providers acting on our behalf,
including recruiting, hosting, analytics, communications, security, and other
technology providers.

referrals, public sources, and business partners where permitted by law.

4. How We Use Personal Information

improve our website and digital services.

·    Respond to inquiries, requests for information,
project inquiries, and business communications.

assess, and onboard job applicants.

5. Recruiting and iCIMS

Polk Mechanical uses iCIMS and related recruiting
technologies to support applicant tracking, candidate communications, interview scheduling, recruiting workflows, offers, onboarding, and related talent-acquisition activities. When you apply for a job or otherwise participate in our recruiting process, information you submit may be processed through iCIMS or other service providers acting on our behalf.

Applicant information may include contact details, resume
and employment history, education, certifications, application responses, interview feedback, assessment information, references, communications, and other information relevant to evaluating candidacy. Background checks, where applicable, are handled under separate disclosures, authorizations, and
applicable law.

We use applicant information for legitimate recruiting,
hiring, onboarding, recordkeeping, compliance, workforce planning, and related business purposes. Submission of an application does not create an employment contract or guarantee an interview or employment.

6. SMS/Text Messaging

If you provide a mobile number and consent to receive text
messages, Polk Mechanical and service providers acting on our behalf may send recruiting, interview scheduling, application-status, onboarding, or other communications consistent with the consent you provided. Message frequency
varies. Message and data rates may apply.

You may revoke consent to receive texts at any time using a reasonable method that clearly communicates your request. For supported two-way messages, you may reply STOP (or another recognized opt-out term) to stop further messages. You may reply HELP for assistance where supported. We may send one final message confirming an opt-out. Opting out of text messaging does not prevent you from communicating with Polk Mechanical through other available
channels and does not affect consideration for employment.

Do not send sensitive information, passwords, financial
account information, or government identification numbers by text unless specifically instructed through an approved secure process.

7. Cookies and Similar Technologies

We and our service providers may use cookies, tags, pixels,
local storage, log files, and similar technologies to operate the site, remember preferences, understand site usage, secure the site, measure performance, and support marketing or recruiting analytics. Some technologies are necessary for site functionality; others may be analytics or advertising
technologies.

Where required by applicable law, we will seek consent
before using non-essential cookies or similar technologies. You may also control cookies through browser settings and, where provided, our cookie preference tool. Blocking cookies may affect website functionality.

8. LinkedIn Insight Tag

Our website may use the LinkedIn Insight Tag to measure website visits and conversions, understand campaign performance, and support audience or advertising functions. The tag may collect information such as page URL, referring URL, IP address, device and browser characteristics, and
timestamp. LinkedIn states that direct identifiers are removed from Insight Tag data within a limited period and remaining pseudonymized data is subject to its retention practices.

LinkedIn members may manage advertising preferences through their LinkedIn account settings. We will not intentionally deploy the Insight Tag on pages that collect or contain sensitive data where doing so would conflict with LinkedIn’s requirements or applicable law.

9. How We Disclose Personal Information

We may disclose personal information to the following
categories of recipients for the purposes described in this Policy:       

  • Service providers and processors supporting
    website hosting, cybersecurity, analytics, applicant tracking, recruiting, communications, document management, and other business operations.     
  • Professional advisors, auditors, insurers, and
    legal counsel.   
  • Customers, project partners, vendors, subcontractors, or other business partners when necessary for a requested
    interaction or legitimate business purpose and permitted by law.    
  • Government agencies, courts, law enforcement, regulators, or other parties when required or permitted by law.    
  • Parties to a merger, acquisition, financing, reorganization, sale of assets, or similar corporate transaction, subject to appropriate safeguards.

We do not sell personal information for money. Certain
privacy laws may define some disclosures for targeted advertising or cross-context behavioral advertising more broadly than the ordinary meaning of ‘sale.’ Where applicable, we provide legally required disclosures and opt-out
mechanisms.

necessary for the purposes described in this Policy, including recruiting and employment recordkeeping, legal and contractual requirements, dispute resolution, security, and legitimate business needs. Retention periods vary by

We use reasonable administrative, technical, and physical
safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. No internet transmission or storage system can be guaranteed to be completely secure.

12. Privacy Rights

Depending on where you reside and the law that applies, you
may have rights to confirm whether we process your personal information; access or obtain a copy; correct inaccuracies; request deletion; obtain portable data; and opt out of certain targeted advertising, sales, or qualifying profiling. Some rights are subject to exceptions, verification, and limitations.

To submit a privacy request, use one of the following
methods: (1) email [PRIVACY EMAIL]; and (2) submit the Privacy Rights Request Form available at [PRIVACY REQUEST URL]. We may need to verify your identity before completing a request. Authorized agents may submit requests where permitted by law, subject to verification of authority.

If we deny a request in whole or in part, residents of
jurisdictions that provide an appeal right may appeal by emailing [PRIVACY EMAIL] with the subject line ‘Privacy Appeal.’ If a Texas resident’s appeal is denied, the resident may submit a complaint to the Texas Attorney General.

13. Texas Residents

The Texas Data Privacy and Security Act may provide Texas
consumers rights regarding personal data, including access, correction, deletion, portability, and opt-out rights for targeted advertising, sale of personal data, and certain profiling. The Act contains exemptions, including for certain employment-related information and other regulated data. We will honor applicable rights and obligations where the Act applies.

including recruiting, social media, mapping, or other platforms. Their privacy practices are governed by their own notices. We are not responsible for the privacy practices of unaffiliated third parties.

15. Do Not Track and Preference Signals

Some browsers offer ‘Do Not Track’ signals. Because there is
not a single universally accepted standard for all such signals, our response may vary. Where applicable law requires recognition of an approved universal opt-out mechanism or preference signal, we will process it as required.

16. Changes to This Policy

We may update this Policy from time to time. The revised
Policy will be posted with a new effective or last-updated date. Material changes may be communicated through additional notice where appropriate.
